Question: What are the chances of winning a mesothelioma lawsuit? My father-in-law was recently diagnosed with mesothelioma. He is a disabled vet on a limited income. The life expectancy is only 4-18 months. He and my mother-in-law have filed a lawsuit against the asbestos manufacturer. The concern is that they have very little money and without compensation we are afraid that my mother-in-law will lose their house when he passes. Does anyone have experience with this?
Thanks for answering. The lawyer says that because he has the disease that we have a good case. Mesothelioma is caused almost exclusively by asbestos exposure.
We have filed the suit against the manufacturer because we believe that he was exposed while working in the boiler room while in the army and suing the army just isn't an option.
The lawyer we have retained has been involved with thousands of these cases. He has given us examples of awards won by his law firm, but I want to know what the chances are of not winning.
Answer: Lawsuits like that take years to even get to court. The companies have big time lawyers, much more than the average person can afford. I see commercials on tv all the time about a class action lawsuit against the manufacturer, so that hasn't even come to fruition yet. Like I said, years.
Question: What is mesothelioma and why is there a need to go to court when it comes to this illness? I read in a local paper about people suffering from mesothelioma and am just being curious. Also I do not quite understand why one has to resort to court if one has this illness.
Answer: It's a rare cancer caused by working with asbestos. Companies didn't provide information/protective gear to employees working around this stuff, and were placed in danger without their knowledge.
Question: What are the causes and symptoms of mesothelioma? Does anyone have any information on how mesothelioma develops?
Answer: The primary risk factor for developing mesothelioma is asbestos exposure. I believe I saw a statistic, and you know what they say about statistics, that said 80% of mesothelioma diagnoses are related to asbestos exposure. This does sound about right. Certain exposures to radiation also are known to develop mesothelioma. Here are some of the symptoms taken from beatmesothelioma.blogspot.com
* pain in the lower back or at the side of the chest
* shortness of breath
* difficulty swallowing
* cough
* fever
* fatigue
* abdominal pain, weight loss, and nausea and vomiting (symptoms of peritoneal mesothelioma)
There is a lot more material, definitely more than I can provide, but I figured this could be a start for you. For more, try checking out beatmesothelioma.blogspot.com for more. Hope this helps.
Question: What are tumour markers for mesothelioma? Can anybody tell me names of tumour markers that appear in blood in case of mesothelioma?And can they appear in other types of cancer?
Answer: D2-40 and podoplanin are two blood markers for mesothelioma tumor cells. D2-40 may appear also as a marker for retinal cancer. There are other tests.
This websites give a lot of info.

Question: What did you use as alternative treatment to cure and survive mesothelioma asbestos cancer? Hi, I'm doing a new web site about diagnosis malignant mesothelioma titled http://www.diagnosis-malignant-mesothelioma-prognosis-claims-settlement.com and true stories about people diagnosed with mesothelioma asbestos cancer and USED AN ALTERNATIVE TREATMENT TO SURVIVE LONGER THAN 24 MONTHS . This cancer normally kills people within 24 months, but some survive longer.
I will recognize you as the source
Thanks.
Answer: The ONLY treatment I've ever seen work (and work often!) is the Immuno Augmentive Therapy (IAT) Clinic in Freeport Grand Bahamas. They are run by British and Bahamian medical doctors, and are in my opinion by far the best alternative cancer treatment center in the world.
For some reason, their treatment (small injections you take several times a day containing immune system proteins) works especially well with mesothelioma, and they are well known for treating it, and often get referrels from Stateside and British MD.s.
Visit their website at either...
Question: How can I verify information on mesothelioma? The extent of info on the internet has left me confused. How can I know if the information is genuine? One site-http://www.mesoblog.org/ is simply defined, but I'm unsure if its contents are correct. Please advise. - A concerned cousin of mesothelioma patient.
Answer: I claim no expertise in environmental medicine, but the first page of the blog looks genuine to me.
Your cousin may be entitled to compensation for negligence.
You have probably seen ads on TV that certain law groups want you to call them. I often wonder if the attorneys benefit from these class action lawsuits more than the victim. At least investigate other sources of compensation first.
Actually, the mesoblog's website cautions against responding to TV commercials and billboard ads. The page on legal advice is reasonable.
Question: What if I do have mesothelioma but I don't want to contact the offices of James Sokolove? Who is this guy and is he suing everybody for everything? Look, you have the right to sue in civil court if you were done wrong. But how much is James Sokolove going to keep if you are awarded damages? 10% sounds ok. It will be much more than that I'm sure. Does anybody know? Do such lawyers really care if you receive damages or are they only out to make money?
Really? Why doesn't he charge less?
Answer: Sokolove is a class-action lawyer -- he files class action lawsuits on behalf of thousands or millions of people who have all been harmed in the same way.
If a class has already been certified, then you may claim the benefits of that class action whether you want to participate or not -- but you can also choose to opt-out of the class and pursue your own individual claims if you want.
Generally, class action lawyers get between 20% and 30% of the total recovery -- that being standard in the industry -- but they also bear all the costs, which can run into the millions of dollars for a large lawsuit, and they bear those costs whether the win or lose.
Some lawyers care about the clients more than the money -- some are in it for the business and the profit -- as with any profession, the motivations vary.
Question: Is money awarded to me in a mesothelioma lawsuit taxable? If I am awarded money, I am not sure if I have to give the government half of it or not.
Any help would be greatly appreciated!
Answer: Awards and settlements due to physical injury and physical illness are tax free.
Any part of the award that is for interest, lost wages, or punitive damages is fully taxable IF those amounts are stated separately.
Question: Do you know any women who had mesothelioma? And if so, do you know how they were exposed to asbestos or if anybody else in their family had mesothelioma too? My mom died a few years ago from this disease and we don't know how she was exposed, so just trying to get information.
She was actually a surgical nurse for 30 years. The hospital she worked at was always being renovated as it was very old, but we don't know if that is how she was exposed or not. I am just hoping that it is not some random genetic thing that is completely un-related to asbestos.
Answer: was your mum always a housewife, or did she work? Industrial exposure is by far the commonest these days. Another thing that needs to be excluded is secondary exposure. A significant number of women contracted asbestosis and mesothelioma secondary to dealing with their partner's work clothes.
Question: Mesothelioma? The best Mesothelioma site we found so far is: http://www.mesothelioma-care-community.n… a forum for sharing stories.

Question: my mum has Mesothelioma, how can I take good care of her? She had a surgery 5 weeks ago, the doctor had removed her right lung, she is still very weak now and has a very bad cough in the evenings, she will be having radiotherapy from next week onwards and her chemotherapy will start in July, the doctor told us that there are malignant cells on the area of her heart also and this is very worrying. We live in singapore and
Mesothelioma is very rare here. She is 59 yrs old.
Answer: Mesothelioma Is caused by inhaling asbestos fibers.These fibers under a microcope will show barbs similar to a fishook. there is no way to remove them or to correct the condition.I feel terrible having to say this to you, but all you can do is to stay close to her and tell her every day how much you love and appreciate her.I worked in asbestos abatement for years, and through that training I learned what I do know about the condition. I'm certainly not a doctor.I lost my Mother to cancer two years ago. I'm 54 and my life has changed forever. Nothing in this world can fill that hole in my heart.I will pray for you, your Mother and all your family and Friends. I don't know you religious affiliation but a lot of my heritage is american Indian But I believe that our creator is one and the same.I wish the best possible for all your family especially your Mother. Don't give up keep talking to other doctors and cancer treatment centers. My prayers and thoughts are with you.
Question: what is the typical reward disbursement between family members for Mesothelioma settlements?
no comic commentary please, i'm looking specifically at how the funds are legally distributed between spouse/children/grandchildren when there is no will.
Answer: all class action suits are for the benefit of the lawyers not the victims
Question: How can I find a mesothelioma lawyer? How do I choose a good one? There are so many out there advertising and trying to grab clients.
Answer: Choosing the right lawyer is a very important decision if you are considering pursuing legal action. You should take time to meet with several attorneys before choosing. Make sure your lawyer and his firm has good personal expertise in these cases and inquire about their track record. How many cases have they handled? How many were settled? How many went to trial, and what were the outcomes?
A really solid starter resource is http://mesotheliomasource.info
Question: What percent of a settlement would the lawyer receive in a lawsuit for mesothelioma?
Answer: It would depend on what type of litigation is involved. Cancer from asbestos poisoning has long been at the fore of the legal community and has been handled as class action suits and on an individual basis. The usual attorney fee involved is between 33 - 40 % plus any out-of-pocket expenses for the lawyer.
